Charges Expected to Be Dropped Against Alberta Public Health Act Violators
Charges against several central Albertans, including Whistle Stop Cafe owner Chris Scott, rodeo organizer Ty Northcott, and diner owner Wesley Langlois, are expected to be dropped due to a recent court ruling.
The ruling, issued by Court of King’s Bench Justice Barbara Romaine, found that Alberta’s Public Health Act was violated when politicians, instead of the Chief Medical Officer, made the final decisions on pandemic-related health restrictions. This decision has led the Alberta Crown Prosecution Service to conclude that there is no reasonable likelihood of conviction for those charged with contravening the Public Health Act.
Scott and Langlois were charged with violating health orders related to in-person dining. Scott’s defense team anticipates an acquittal at his upcoming court appearance. Langlois’ charge is also expected to be withdrawn in September.
Northcott had been found guilty of holding a large event, the No More Lockdowns Rodeo Rally, in violation of restrictions on large gatherings. His lawyer will seek a stay of proceedings in light of the ruling.
The decision may be seen as a win for personal liberties and peaceful protest. Defense lawyers have noted the importance of standing up for rights, especially during times when democratic principles are challenged.
